DMCA Compliance
As a real estate brokerage, Genesis Real Estate LLC values and respects all forms of property — including intellectual property (“IP”). We do not tolerate the misuse or unauthorized use of third-party IP on our systems, websites owned or operated by us, or websites for which we manage content or infrastructure (each, a “Company Site”).
Our agreements with users and contributors of Company Sites specifically prohibit the uploading, posting, emailing, or transmission of any content or material that infringes upon the IP rights of others. To enforce this policy and protect the rights of creators and copyright holders, Genesis Real Estate provides a process for submitting complaints under the Digital Millennium Copyright Act of 1998 (17 U.S.C. §512) (“DMCA”).
Notice of Copyright Infringement
If you believe that material appearing on a Company Site infringes upon a copyright you own, or that you are authorized to act on behalf of the copyright owner, you may submit a written Notice of Claimed Infringement (“Notice”) to our Designated DMCA Agent.
Your Notice must include the following information:

Your full name, address, telephone number, and email address.

A description of the copyrighted work that you claim has been infringed (please include registration numbers, if applicable).

A description of the material you believe to be infringing, including its exact URL or location on the Company Site.

A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.

A statement, made under penalty of perjury, that the information in your Notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner.

Counter-Notice
If you believe your content was removed or disabled in error or misidentification, you may submit a Counter-Notice pursuant to Section 512(g)(2) and (3) of the DMCA.
Your Counter-Notice must include the following:

Your full name, address, telephone number, and email address.

Identification of the content that was removed or disabled and the location where it appeared before removal.

A statement, under penalty of perjury, that you have a good-faith belief the content was removed or disabled due to mistake or misidentification.

A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if outside the U.S., to the Federal District Court for the District of Alaska, and that you will accept service of process from the person who provided the Notice or their agent.

Procedure
Upon receiving a valid Notice, Genesis Real Estate will make a good-faith effort to forward it to the individual or entity that posted the allegedly infringing content. The Company may remove or disable access to the identified material at its discretion.
If a valid Counter-Notice is received, we will forward it to the original complainant. Unless the complainant notifies us within 10 business days that they have filed an action seeking a court order, we may reinstate the material within 14 business days, where technically feasible.
